Note: Under the French copyright law (Code de la Propriété intellectuelle) simple drawings, graphs, and raw representations, do not constitute an "œuvre de l'esprit" (work of authorship) and are not protected by law. Furthermore, the following apply to works authored by a state employee, or as a result of archeological operations:

  • Article L131-3-1 Pertaining to works authored by a state employee: The rights of a work created by a state employee for the accomplishment of a public service or a mission are, from the moment of creation, transferred to the State.
  • Article L523-12 Archaeological material resulting from preventive archaeology operations is entrusted, under the control of the State services, to the preventive archaeology operator for the time necessary to draft the operation report. This period cannot exceed two years. The provisions of article L. 523-14 are then applied. Drawings of an archaeological excavation survey: if this original map (therefore protected by copyright) is made in the context of an archaeological excavation site, the Heritage Code sets a time limit during which the researcher is the only one who can study the archaeological material, with a view to writing the operation report. This period of study is limited to two years but can be extended by 3 additional years, in the case of preventive archaeological excavations, that is to say when archaeological remains are discovered during a construction site (Ccode du Patrimoine, art. L.523-12). At the end of this five-year period, the excavation report, including the documentation and in particular the field surveys, must be submitted to the State (to the regional archaeology department): this document will be available for consultation by all.
  • Article L.531-11 and L.531-16 As far as programmed archaeology is concerned (excavations undertaken in the case of fortuitous discoveries, or excavations carried out by the State with the aim of carrying out archaeological research, and not on the occasion of a preventive excavation site), the time limit for the study of exhumed archaeological material is fixed at 5 years (Code du Patrimoine, art. L.531-11 and L.531-16).
Public domain
This work is in the public domain in France for one of the following reasons:
  • Its author (or the last of its authors in the case of a collaboration work) died more than 70 years ago (CPI art. L123-1) and did not benefit from any copyright extension (CPI art. L123-8, L123-9 and L123-10)[1];
  • It is an anonymous or pseudonymous work (the identity of the author has never been disclosed) or a collective work[2] and more than 70 years have passed since its publication (CPI art. L123-3);
  • It is the recording of an audiovisual or musical work already in the public domain, and more than 50 years have passed since the performance or the recording (CPI art. L211-4).

Please note that moral rights still apply when the work is in the public domain. They encompass, among others, the right to the respect of the author's name, quality and work (CPI art. L121-1). Attribution therefore remains mandatory.
  1. Copyright extensions must be considered only in the case of musical works and of authors Mort pour la France (died during conflict, in the service of France). In other cases, they are included in the 70 years post mortem auctoris length (see this statement of the Cour de Cassation).
  2. The collective work status is quite restrictive, please make sure that it is actually established.
