Dieses Werk stellt die in Deutschland hergestellte Fälschung oder Verfälschung eines Originals dar, das ursprünglich von der Britischen Post veröffentlich worden ist. Nach deutschem Urheberrechtsgesetz kann ein Fälscher an der Fälschung kein neues Copyright erlangen (§107 Abs.2 UrhG). Da Fälscher in der Regel unerlaubt handelnde Personen sind, steht ihnen auch keine Miturheberschaft nach §8 UrhG zu. Somit gilt für dieses Werk die gesetzliche Regelung, wie sie am Original anzuwenden wäre.

This work displays the forgery or distortion of an original, produced in Germany, initially issued by the British post office. According to the German Copyright law a forger is not able to achieve a new copyright as to the forged work. (§107 Abs.2 UrhG). Because of the fact that forgers usually are illegally acting persons, they cannot claim any Co-Copyright as well (§8 UrhG). Therefore the same legal regulation is applicable to the forgery as if it were the original work.

	Da diese Briefmarke nicht von der Reichspost, sondern unmittelbar von der NS-Regierung beauftragt worden ist, gilt diese als Amtliches Werk. Sie ist somit gemeinfrei:

	§ 62 UrhG verbietet die Vornahme von Änderungen an dem im Rahmen der Panoramafreiheit benutzten Werk (Abs. 1). Bei Werken der bildenden Künste und Lichtbildwerken sind Übertragungen des Werkes in eine andere Größe und solche Änderungen zulässig, die das für die Vervielfältigung angewendete Verfahren mit sich bringt (§ 62 Abs. 3 UrhG).

	According to a decision of the German Supreme Court the copyright status of the photographer is not restricted. The fact that a photographer is referring to his right of "Panoramafreiheit" does not restrict his own copyright status concerning the photography taken. (BGH ; January 19, 2017, I ZR 242/15)
